Valastro attended his arraignment flanked by his lawyers; he didn't enter a plea. He's due back in court in January.

Police stopped Valastro near 10th Avenue after following him for a bit; they said he was unsteady on his feet when he stepped out of the vehicle. They say his face was flushed and his eyes were bloodshot. He allegedly failed a Breathalyzer test and was taken into custody.

Prosecutors say Valastro allegedly told arresting officers, "You can't arrest me. I'm the Cake Boss," and asked to be put into a cab.

Prosecutors say Valastro also allegedly admitted to police that he had had a few drinks before getting behind the wheel.

In a statement to his family, friends and fans Thursday, Valastro said: "Please know that I want to share and explain to you what happened today and I look forward to doing so at a later date. I appreciate your support and understanding as we handle things privately as a family."
